These Terms of Service are an agreement between you and Fressh Designz of Bethel, Connecticut (“Fressh Designz,” “we,” “us”). They govern your use of fresshdesignz.com and every order you place with us.
By visiting our site, placing an order, or purchasing any product from Fressh Designz, you agree to these Terms of Service and to our Privacy Policy, Refund & Returns Policy, and Shipping Policy. By purchasing, you also acknowledge that you have read and agreed to the Assumption of Risk, Waiver and Release of Liability section below. If you do not agree, please do not order. You must be at least 18 years old to purchase, or purchase with the consent of a parent or legal guardian.
Fressh Designz sells custom temporary tattoos, fine-line stencil transfers for use by tattoo artists, and wearable tattoo sleeves, sold online. Designs are created by us, selected from our design library, or created from artwork and descriptions you provide.
Our products are made to order, for you. Production begins only after you approve the proof we email you. Approving the proof authorizes us to produce your order exactly as shown in that proof — design, spelling, size, and colors. Please review your proof carefully before approving it. Once you have approved the proof, changes may not be possible, and orders produced to match an approved proof are not eligible for refund based on anything visible in that proof.
When you upload or submit an image, design, or other artwork, you represent and warrant that you own it or have all rights and permissions needed to use it and to have it reproduced by us. You grant Fressh Designz a limited license to use the artwork solely to design, produce, and deliver your order and to provide customer support for it.
You agree to indemnify and hold harmless Fressh Designz from and against any claims, damages, liabilities, and expenses arising out of artwork you submit, including any claim that it infringes another party's copyright, trademark, or other rights.
We may decline any submission at our sole discretion, including submissions we believe infringe the rights of others or are unlawful, hateful, or otherwise inappropriate.
All designs, artwork, images, and content created or offered by Fressh Designz — including our design library — are the intellectual property of Fressh Designz. Purchasing a product gives you a license to use that product for your personal use only. You may not copy, reproduce, resell, redistribute, or use our designs commercially in any form.
Our stencil transfers are design and transfer aids intended to be used by a tattoo artist. They are not medical products and do not include tattooing services. The tattoo artist performing the work has final say on the size, placement, and suitability of any design, and may modify a stencil as they judge appropriate. Fressh Designz is not responsible for the permanent tattoo itself, the artist's work, the tattooing process, or how a permanent tattoo heals or ages.
Our temporary tattoo and sleeve products are cosmetic novelty products intended for external use on intact skin only, exactly as directed in the application instructions provided with each product. Always follow the application instructions and patch-test guidance provided. Safety information is also summarized on our Legal & Policies page. The Assumption of Risk section below forms part of these safety terms.
Please read this section carefully. It affects your legal rights.
You understand and acknowledge that applying any cosmetic skin product involves inherent risks, including the risk of individual skin sensitivities, irritation, and allergic reactions, which vary from person to person and cannot be predicted for any particular individual. By purchasing and using our products, you voluntarily assume all risks associated with their application, wear, and results.
Our products are used at your own risk. Products must be used exactly in accordance with the application instructions and patch-test guidance provided with them, including performing a patch test before first full application and discontinuing use if irritation occurs. Any use of a product contrary to those instructions — including applying it to broken, irritated, or sensitive skin, or ignoring the safety guidance — is solely your responsibility.
To the fullest extent permitted by applicable law, you hereby release, waive, and discharge Fressh Designz, and its owner, agents, employees, and printing and fulfillment partners, from and against any and all claims, demands, damages, losses, and causes of action of any kind arising out of or related to your purchase, application, use, or results of our products, except to the extent caused by our gross negligence or willful misconduct.
To the fullest extent permitted by applicable law, the total liability of Fressh Designz for any claim arising out of or related to an order or product shall not exceed the amount you paid for the specific order giving rise to the claim. In no event shall Fressh Designz be liable for any indirect, incidental, special, or consequential damages.
You agree to indemnify, defend, and hold harmless Fressh Designz and its owner, agents, and printing and fulfillment partners from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) artwork or content you upload or submit, or (b) your misuse of our products or your failure to follow the instructions and safety guidance provided with them.
Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under applicable law. If any part of this section is found unenforceable, the remaining parts continue in full effect.
This section applies to photos, images, videos, reviews, and other content you submit to Fressh Designz for display or marketing purposes — including submissions to our customer photo program (for example, photos of you wearing your Fressh Designz tattoo), whether sent by email, submitted through a form on our site, or posted by tagging or mentioning Fressh Designz for the program. It is separate from artwork you provide for an order, which is governed by Section 4.
By submitting content to Fressh Designz, you grant Fressh Designz a worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, edit (including cropping and color adjustment), publish, display, and distribute the content, in whole or in part, in our marketing, advertising, social media, and website, and in any other promotional materials, without any compensation to you beyond any program reward expressly offered for the submission. You understand that submitted content may appear publicly, including on our social media pages, and you waive any right to inspect or approve the finished use.
By submitting content, you represent and warrant that (a) you own the content or have all rights and permissions necessary to grant the license above, and (b) every identifiable person appearing in the content has consented to its submission to Fressh Designz and to its use as described in this section. You agree to indemnify and hold harmless Fressh Designz from and against any claims arising out of content you submit, consistent with Section 8.5.
Our photo program accepts and publishes only submissions depicting adults aged 18 or older. By submitting content, you represent and warrant that every person depicted in the content is 18 years of age or older. Fressh Designz does not knowingly accept, publish, or use any photo or other content featuring a minor, and any such submission will be deleted and will not be used. This rule has no exceptions: it applies regardless of who submits the content — including a parent or legal guardian — because we cannot reliably verify parental consent for remote submissions.
Where Fressh Designz offers a reward for submissions (for example, a discount or free-shipping code for a future order), rewards are issued at our sole discretion after review, are non-transferable, and have no cash value. We may withhold a reward for content that is off-topic, of insufficient quality to publish, duplicative, or in violation of these Terms. We are under no obligation to use, publish, or retain any submission. If you submitted content, or you are a person depicted in published content, you may ask us to remove it by emailing thefresshdesignz@gmail.com; we will remove it from the platforms we control on a going-forward basis, except that copies already printed, distributed, or reposted by third parties cannot be recalled.
Our products are cosmetic novelty items. We make no medical, therapeutic, diagnostic, or health claims for any product, and nothing on our site is medical advice.
Prices are shown at checkout and may change without notice. Payment is due in full when you place your order. An order is not in production until your proof is approved, as described in Section 3.
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-law rules. Any dispute arising out of these Terms or your order shall be resolved in the state or federal courts located in Connecticut.
We may update these Terms from time to time. The version posted on our site at the time you place an order governs that order. Continued use of our site after changes are posted constitutes acceptance of the updated Terms.
